Users are not required to register to access the Web site. However, in order to contract any of the services offered by WATCHILDS-GPS.COM, the registration of the User and the acceptance of these conditions will be required before formalizing payment.

Through the website, WATCHILDS-GPS.COM offers Users products of the WATCHILDS-GPS.COM brand.

The present Terms and Conditions of WATCHILDS-GPS.COM described below define the rights and obligations of WATCHILDS.COM and the Users within the framework of the Website. These are the only Terms and Conditions applicable to the use of the Website (without prejudice to the fact that for certain services there may be specific conditions) and to the placing of orders through the Website, and they replace any other conditions, unless previously agreed to in writing between WATCHILDS-GPS.COM and the User.

• User Data

In order to purchase the products offered through the Website it will be necessary for the User to register through the registration form available on the Website.

The User will be responsible for maintaining the confidentiality of the data and information provided and for restricting access to his/her computer and passwords to avoid possible unauthorized use.

In the event that the User has reason to believe that his or her data has been made known to a third party, or if it has been used in an unauthorized manner, or is susceptible to unauthorized use, he or she should communicate this situation to WATCHILDS-GPS.COM immediately.

The User should verify that their information is correct and complete and inform WATCHILDS-GPS.COM when there is any variation and/or modification in the information provided in the purchase process.

• Orders and Terms and Conditions of Sale

The services and products offered through the WATCHILDS.COM Website are intended for the purchase by Users of WATCHILDS.COM brand products.

In order to place an order with WATCHILDS.COM, the User must be at least 18 years of age.

From the Website www.WATCHILDS.COM, orders can be shipped to any part of the world.

In order to place orders through the Website, the User must provide a series of data prior to placing an order, through the purchase form, and which will be necessary in order to manage the purchase order. Cancellations will not be admitted.

• Price, payment method and discount codes

Once the information on the form has been completed, the User must proceed to the payment of the order through the means of payment specified on the Website.

After the payment has been made, the User will receive an e-mail confirming the order, which will include a summary of the items purchased, the shipping method requested and the destination address.

The prices of the services are expressed in USD ($), including handling and shipping costs, the amount of which will be indicated at the time of the final confirmation of each order.

WATCHILDS-GPS.COM may periodically offer discount codes to its Users. These discounts can only be applied according to the instructions specified by WATCHILDS-GPS.COM with respect to each code, and in any case, Users can only use a single code per order.

The use of discount codes will not be compatible with certain promotional actions and collections.

• Information about WATCHILDS-GPS.COM products and services.

The information included on the website in each description of the products and services, in its photographs, graphic or iconographic representations or videos, as well as commercial names, brands or distinctive signs of any kind, are merely informative. Therefore, WATCHILDS.COM declines any responsibility for the appearance of errors in said information, although it commits to take all measures within its reach to correct said errors or omissions as soon as possible after having been informed of them.

• Returns and right of withdrawal

Returns due to manufacturing defects.

The User will be able to return to WATCHILDS-GPS.COM, free of charge, any product which presents a manufacturing defect. Taking into account the nature of the products contracted, the User will have a period of 48 hours after receiving the product to communicate to WATCHILDS-GPS.COM their lack of conformity with the product. If this period is exceeded, any damages will be assumed by the User.

The return of products which present manufacturing defects will not entail any additional cost for the User.

To formalize the return, the User should contact WATCHILDS-GPS.COM, using the following contact form, indicating the product or products to be returned, the order number, attaching a photograph and a detailed list of the defects. Requests will not be accepted by any other means other than the one mentioned above.

Once WATCHILDS-GPS.COM has received the User’s communication, WATCHILDS-GPS.COM will inform the User within 3-5 business days whether or not the product can be returned. In the case of a return, WATCHILDS*GPS.COM will indicate to the User the method of collection or shipment of the defective product to its offices/warehouses.

The offices/warehouses to which Users can send the defective product will be provided through these communications.

Each product to be returned must be unused and with all its labels, packaging and, where appropriate, documentation and original accessories that came with it. If the User fails to do so, WATCHILDS-GPS.COM reserves the right to refuse the return.

Once the product has been received and the defects have been confirmed, WATCHILDS-GPS.COM will give the User the possibility of replacing the product with another of identical characteristics, unless this option is objectively impossible or disproportionate for WATCHILDS-GPS.COM.

In the event that, for reasons of lack of stock, the delivery of another product with identical characteristics is not possible, the User will be able to choose between terminating the contract (i.e., refunding the amounts paid) or requesting the delivery of another model that the User voluntarily chooses.

The delivery of the product with identical characteristics or of the new model chosen by the User, as applicable, will be carried out within a period similar to that contracted in the original order, counting from the date on which WATCHILDS-GPS.COM confirms to the User the replacement of the defective product or the shipment of the new model.

The replacement, the shipment of a new model, or the termination of the contract will not imply additional costs for the User.

If the User terminates the contract, WATCHILDS-GPS.COM will refund the full amount paid to the User for the purchase of the defective product (including shipping costs).

WATCHILDS-GPS.COM informs Users that the time period for the refund of the amounts paid will depend on the method of payment used by the User when purchasing the product:

If the User has made the payment by credit/debit card, WATCHILDS-GPS.COM will refund the amount paid within 14 calendar days of the User deciding to terminate the contract.

If the User paid by PayPal, WATCHILDS-GPS.COM will refund the amount paid within 3-4 business days after the User decided to terminate the contract.

No returns will be accepted in which there has been a misuse by the User of the product, such as a breakage due to a blow, or a long and continuous exposure to water. Incompatibilities with certain SIM cards are not considered a manufacturing defect and will not be accepted for return, in which case we recommend changing the SIM card to a compatible one.

Withdrawal.

In the event that the User is not satisfied with the products received in your order, the User, in accordance with the General Law for the defense of Consumers and Users, shall have a period of fourteen (14) calendar days to return the entire order or, if you prefer, you may return any of the products that make up the total order. For those orders voluntarily relabeled by the user will count as delivery date of the order the date on which it was relabeled, since at that time we lose control of the shipment in favor of the customer.

However, the User will be responsible for the direct cost of returning the order to WATCHILDS-GPS.COM, whether he/she returns the entire order or decides to return only some of the products in the order.

Additionally, if the initial shipping costs were free for promotional reasons, the amount to be returned to the user will be reduced by 10 USD  corresponding to the original shipping costs.

To formalize the return, you must contact WATCHILDS-GPS.COM using the following contact form, indicating your order number and the reason for the return. Once this communication has been received, WATCHILDS-GPS.COM will indicate how to send the order to its offices or warehouses. Requests made after the deadline or by other ways and means different from the aforementioned will not be accepted.

We will not accept any product received for return that arrives at our warehouse without the customer having contacted us beforehand and the procedure to proceed with the shipment has been managed and confirmed. These cases include the refusal of the goods on delivery or returns due to incorrect addresses entered by the customer.

WATCHILDS-GPS.COM is not responsible for the courier company that the User hires for the return of the order. In this sense, WATCHILDS-GPS.COM recommends that the User demand that the courier company provide proof of delivery once the courier has deposited the product in the offices/warehouses of WATCHILDS-GPS.COM, so that the User has proof that the product has been correctly delivered to WATCHILDS-GPS.COM.

The costs of returning the order (such as shipping costs through courier companies) will be borne directly by the User. 

The product must be unused and with all its labels, packaging and, where appropriate, original documentation and accessories that came with it. If the User does not do so, or if the product has been damaged in any way, the User accepts that the product may suffer depreciation or that WATCHILDS-GPS.COM may refuse to return it.

Once WATCHILDS-GPS.COM receives the order and verifies that it is in good condition, WATCHILDS-GPS.COM will proceed to refund the full amount paid by the User except for shipping costs, if the initial shipping costs were 0$ for promotion, the user will be refunded the full price of the purchase minus the original shipping costs.

WATCHILDS-GPS.COM informs Users that the time period for the refund of amounts paid will depend on the method of payment used by the User when purchasing the product:

If the User has paid by credit/debit card, WATCHILDS-GPS.COM will refund the amount paid within 14 calendar days of the User deciding to terminate the contract.

If the User paid by PAYPAL, WATCHILDS-GPS.COM will refund the amount paid within 3-4 working days of the User’s decision to terminate the contract.

In any case, WATCHILDS-GPS.COM will return the amounts paid as soon as possible and, in any case, within 14 calendar days from the date on which the User informed of his or her decision to withdraw from the contract.

Loss or shipping incidents

Under no circumstances can orders that have left the warehouse and are in transit be cancelled, modified or refunded. If there are delays in shipments contact us, if it is more than 7 days, we will try to compensate you in some way. To confirm that an order has been lost, 60 days must pass from the date of purchase, in which case the user will be refunded 100% of the amount, at the end of this period. 

 WATCHILDS-GPS.COM is not responsible for incidents or delays caused by incorrect or incomplete addresses entered by the user.

• Product Exchange Policy

WATCHILDS-GPS.COM does not allow the exchange of a product purchased by the User for another product offered on the Website.

• Warranty

The device is guaranteed for 2 years. If it is a hidden defect, it is presumed that there is a manufacturing defect during the first 6 months, thereafter the user must prove that the faults or hidden defects came from origin by providing the relevant evidence.  In order for us to proceed to the replacement of the item, it must be delivered with its original box and accessories.  Additionally, the cases in which there has been a misuse by the user of the product, such as a breakage due to a blow, or a long and continuous exposure to water, would not be covered by the warranty. Incompatibilities with certain SIM cards are not considered a manufacturing defect and will not be accepted for return, in which case we recommend changing the SIM card to a compatible one.

For the warranty to apply it is essential that you indicate the order number indicated in the email confirmation of purchase, as the latter acts as proof of purchase.

In case the problem is lack of coverage, the procedure would be as follows, it would be reviewed in our facilities, if it presents failures we proceed immediately to the replacement of the same, if on the contrary we do not find failures and the error is due to lack of coverage in a certain area, WATCHILDS is not responsible.

If the device has bumps or external damage that have not been reported by the user within 24 hours after receipt of the order, it is assumed that they have been caused by the latter and therefore would no longer be entitled to the warranty.

• Use of the Web Site

You may not use the Web Site for fraudulent purposes, or in connection with criminal offenses or unlawful activities of any kind.

It is also prohibited to send, use or reuse illegal, offensive, abusive, indecent, defamatory, obscene or threatening material of any kind, or that involves a violation of intellectual property rights, trademarks, confidentiality, privacy or any other right, or is otherwise injurious or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising content, chain letters, mass mailings or any other type of “spam” and, in general, any kind of nuisance or unnecessary inconvenience.

The User undertakes to make a lawful, diligent, honest and correct use of any information or content accessed either through the Website or third party websites to which you have access through the links on the Website, and all under the principles of good faith and with respect at all times to the law and these Terms and Conditions.

Likewise, the User undertakes not to maliciously or intentionally cause damage or harm that may undermine or alter the Website itself or introduce or disseminate computer viruses that may cause unauthorized alterations to the contents or systems of the Website.

WATCHILDS-GPS.COM reserves the right to deny access to the Website or even cancel orders to Users who misuse the content and/or violate any of the conditions that appear in this document.

• Intellectual or Industrial Property

The intellectual property rights of the website www.WATCHILDS-GPS.COM, its source code, design, navigation structures and the different elements contained therein are the property of WATCHILDS-GPS.COM, who has the exclusive rights to exploit them in any form and in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with applicable Spanish and European legislation.

WATCHILDS-GPS.COM informs that it does not grant any express or implicit license or authorization for intellectual and/or industrial property rights or for any other right or property related, directly or indirectly, to the content included on the Website. The total or partial reproduction of the contents of the Website, not even by means of a hyperlink, is strictly prohibited without the express written consent of WATCHILDS-GPS.COM. Unauthorized use of this content will give rise to the legally established responsibilities.

The hyperlinks contained in the website may lead to third party websites. WATCHILDS-GPS.COM assumes no responsibility for the content, information, or services that may appear on these sites, which are offered exclusively for informational purposes by WATCHILDS-GPS.COM, and which in no case imply any relationship, acceptance, or support between WATCHILDS-GPS.COM and the persons or entities that own such content or the owners of the sites where they are found.

• Partial invalidity

In the event that any provision of these Terms and Conditions is declared invalid, the remaining provisions shall remain in full force and effect and shall be interpreted in the spirit of these Terms and Conditions.

• Modifications

The information that appears on this Website is current as of the date of its last update. WATCHILDS-GPS.COM reserves the right to unilaterally modify these Terms and Conditions, as well as its privacy policy and any other information. The entry into force of the modifications to the Terms and Conditions will take place from the moment of their publication on this Website.

• Personalization of campaigns

The User is the subject of a random campaign, so the shipping terms applicable to each order may vary randomly. The User’s personal data will not be taken into account as a variable when determining the particular conditions of each order.

• Notifications

All communications between WATCHILDS-GPS.COM and the User regarding the placement of orders through the Website will be made in writing and in accordance with the communication procedures established in these Terms and Conditions for each particular case.

• Applicable Law and Jurisdiction

These Terms and Conditions are subject to Spanish law. The parties, in accordance with Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, submit to the Courts and Tribunals of the place of residence of the User.
